Temporary residence permit: granted to foreign nationals who intend to live in Spain for more than 90 days and less than five years; depending on the type of permit, it may or may not allow you to work.

Non-lucrative residence: for people who live in Spain on their own financial means, without working.

Residence on exceptional grounds: granted, among other cases, on the basis of arraigo (ties to Spain): social, socio-labor, socio-training, family or second-chance arraigo.

Long-term residence permit: granted to those who have lived in Spain legally and continuously. It gives rights similar to those of Spanish citizens, including the right to work.

Legal residents whose residence permit has been renewed can apply to bring their immediate family members to Spain.

If you are not an EU, EEA or Swiss national and you join or accompany a family member who is a national of another EU or EEA country or of Switzerland, you must apply for and obtain an EU family member residence card if you are going to live in Spain for more than three months.

Since May 2025, family members of Spanish citizens have generally had their own, separate residence permit.

Initial authorization:
the employer files the application with the Immigration Office (Oficina de Extranjería); an employment contract signed by both parties is required.

Non-EU nationals can apply for residence to work remotely, as employees or freelancers, for companies based outside Spain, using only computers, online tools and telecommunications.

The residence permit for highly qualified professionals is a key procedure that makes it easier for highly qualified foreign talent to come to and stay in Spain. It sets clear requirements for both the applicant and the hiring company, and offers significant advantages: faster processing and greater mobility, including for the family.

The EU Blue Card is a legal instrument designed to attract and retain highly qualified talent in the European Union. It makes it easier for these professionals and their families to enter the EU and to move between member states, with rights and benefits comparable to those of EU citizens.

For foreign nationals aged 18 or over who plan to carry out an innovative business project of special economic interest to Spain.

For foreign nationals who wish to carry out training, research, development and innovation activities at public or private organizations established in Spain and who have an offer to do so.

Where exceptional circumstances justify it (for example, humanitarian or family reasons, or public interest), nationals of countries that do not need a visa to enter Spain may be authorized to extend their stay beyond 90 days, for purposes other than work or residence.

Administrative appeals:
Recurso de alzada (appeal to a higher authority) and recurso de reposición (request for reconsideration).

Judicial review: administrative decisions can be challenged before the administrative courts (jurisdicción contencioso-administrativa), which review whether the authorities acted lawfully.
